1. Introduction
Welcome to PowerUX, a product developed and operated by AMPLIFY IT. These Terms and Conditions ("Terms") govern your access to and use of PowerUX, a suite of tools designed to help makers and developers quickly implement and extend Power Apps and Dynamics 365 Customer Engagement business applications.
By subscribing to PowerUX and using the service, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.
2. User Accounts & Access
2.1 Registration & License Activation
Users must install PowerUX only in their development environment.
To activate the product, users must subscribe to obtain an active license key for their tenant.
2.2 User Roles
Admin: Manages settings, configures automation rules, and oversees the integration of solution-aware components.
Maker: Configures business logic to extend the PowerApps user experience but cannot modify or extend the product itself.
2.3 License Scope & Usage
The license is per tenant, allowing unlimited users within that tenant.
Usage limits are based on the number of publish requests, which trigger workflows to generate scripts and integrate components.
2.4 Account Termination & Suspension
PowerUX reserves the right to suspend or terminate accounts if:
The product is used for an ISV product and distributed across customer tenants without prior notification.
The product is used in violation of these Terms.
3. Subscription & Payment Terms
3.1 Subscription Model
PowerUX operates on a subscription-based model.
Users can choose between monthly and yearly billing cycles.
3.2 Payments & Billing
Payments are processed via Stripe (credit card, Bancontact) or bank transfer upon agreement.
3.3 Refund & Cancellation Policy
No refunds are provided once a subscription payment is processed.
Users may cancel their subscription at any time, and access will remain active until the end of the current billing period.
3.4 Pricing Changes
We reserve the right to modify pricing at any time.
Users will be notified via email before any price changes take effect.
4. Data Privacy & Security
4.1 Data Collection
PowerUX collects only configured UX flows created by the maker to generate scripts.
This includes schema names of fields, tabs, sections, form IDs, and table schema names.
4.2 Processing of Personal Data
PowerUX does not process sensitive or personal data.
PowerUX does not share user data with third parties.
4.3 GDPR & Privacy Compliance
As we do not process personal data, we remain compliant with GDPR and other privacy regulations.
5. Service Availability & Uptime
5.1 Service Level Commitment
PowerUX commits to a high-availability service with an uptime goal of 99.9%, except for maintenance periods.
5.2 Maintenance & Downtime
While scheduled maintenance is not frequent, we reserve the right to perform it when necessary.
Any significant downtime will be communicated in advance.
5.3 User Notifications
Users will be notified of maintenance, service interruptions, or major updates via email.
6. Acceptable Use & Restrictions
6.1 Prohibited Activities
Users must not:
Use PowerUX for illegal activities.
Intentionally cause errors or disruptions in third-party environments.
6.2 Product Limitations
Users may only use the generated scripts and components within their tenant.
The product cannot be modified, extended, or redistributed unless through our Partner Program.
7. Intellectual Property & Licensing
7.1 Ownership
AMPLIFY IT retains full ownership of PowerUX, its components, scripts, and integrations.
Users may deploy generated scripts and components within the same tenant for unlimited environments.
7.2 Resale & Distribution
Users cannot resell or distribute PowerUX unless they are part of our official Partner Program.
8. Termination & Data Handling
8.1 Subscription Cancellation
If a user cancels their subscription, access remains available until the end of the billing period.
8.2 Data & Service Continuation
Previously generated scripts and components will continue functioning even after subscription termination.
9. Governing Law & Dispute Resolution
9.1 Jurisdiction
These Terms are governed by the laws of Belgium.
9.2 Dispute Resolution
Any disputes will be settled in Belgian courts.
10. Changes to Terms
10.1 Updates & Notifications
PowerUX reserves the right to update these Terms as needed.
Users will be notified via email of any significant changes.
